（1）任何人供应或提议供应任何电子香烟装置或配件，应向主管当局申请获得该电子香烟装置或配件的认证；
（2） 中所述的电子香烟装置或配件。
（一）款应为：——
（a） 经主管当局证明符合马来西亚标准MS 2716；
（b） 标有附表中规定的SIRIM标记。
（二）（b）分节须予标记的电子香烟装置或零件，均须将附表所指明的标记张贴在以下位置的显眼位置而予以标记：——
（a） 电子烟装置或配件；或（b） 提供电子香烟设备或配件的任何物品。
法规背景：
在联邦政府根据《2011年商品说明法》在宪报刊登《2022年电子烟设备商品说明（认证和标记）令》之后，电子烟的本地制造商和进口商现在必须申请SIRIM认证和标签。Trade Descriptions(Certification and Marking of Electronic Cigarette Device) Order 2022, 发布日期：2022.03.31, 生效日期：2022.08.03。
相关的Order是部长在行使《Trade Descriptions Act 2011》[730号法案]第29节赋予的权力针对电子烟信息标签以及相关的认证提出要求。Trade Descriptions Informative marking and certification orders29. ( 1 ) Where it appears to the Minister necessary or expedient in the interest of persons to whom any goods or any services in relation to that goods are supplied that the goods should be( a ) certified by a competent authority b ) marked with a mark determined by the Minister : or( c ) accompanied by any information ( whether or not amounting to or including a trade description ) or instruction relating to the goods
法规对象：
“electronic cigarette device”的定义参考马来西亚标准MS2716 – Electronic cigarette device – Safety requirements and test methods。
“spare part”-指电子香烟装置的任何可互换部件；
电子烟, 以及相关的电子元装置的任何可替换部件为本令的监管范围, 不包括相关的E-liquid。
主管机构：
就本命令而言，SIRIM QAS International Sdn.Bhd.应为法案第29（3）小节中提及的主管当局，以证明并发布电子香烟装置或配件符合马来西亚标准MS 2716的标记 。
注：法案是trade description act 2011；
(3) For the purpose of this section, “competent authority " means a competent authority named by the Minister after obtaining the agreement of the competent authority.
A. components零部件要求：
Battery:满足相关MS IEC 62133-2；
Charger: 满足相关MS IEC 60950-1；
USB ports: 满足相关MS IEC 60950-1。
注: 相关的components遵循electricity supply act要求
B. Electronic control units(ECU)电子控制单元：
1. Automatic cut-off自动切断；
2. Child lock儿童锁相关要求；
3. Automatic sleep自动睡眠。
相关要求需要标准设计, 并且需要通过MS 2716的functional test功能性测试.
C. Safety test安全测试：
1. Drop test, 遵循相关MS IEC 62133:2017对应测试要求, 1m跌落, 注意方向以及相关的compliance符合性要求；
2. External short circuit test, 遵循相关MS IEC 62133:2017对应测试要求；
3. Risk of burns, 正常工作状态的温升测试, 金属部分, 塑料部分以及相关的橡胶部分的正常发热需要遵循temperature rise test；
4. Mechanical test, 机械测试，包括相关的电子烟液的溢出测试，符合UL 1439的机械组装测试, 密封性能测试，振动测试(XYZ三方向, 10-55Hz，每个方向90min), 冲击测试。
D．chemical test, 化学测试方面相关的烟嘴应该是满足食品级
E. EMC test, 电子烟装置满足IEC 61000-6-1和IEC 61000-6-3要求
F．wireless connectivity test, 满足相关的TC T007:2014
G. functional test, 功能性测试, 针对相关的功能以及ECU单元的要求; 包括ON/OFF功能, auto cut-off system自动切断系统, auto shut down， anti-overcharged; 其他的temperature or power control system温度和电源控制系统方面或者其他功能性方面的确认.
